Tamil Nadu PSTM (Amendment) Act 2020 in Tamil

தமிழ்நாடு சட்டமன்றத்தின் பின்வரும் சட்டம் 7 டிசம்பர் 2020  ஆம் தேதி ஆளுநரின் ஒப்புதலைப் பெற்றது,  பொதுவான தகவல்களுக்காக  இது வெளியிடப்படுகிறது:

 2020 ஆம் ஆண்டின் 35 வது சட்டம்  

தமிழ் வழியில் படித்த நபர்களை  முன்னுரிமை அடிப்படையில் மாநிலத்தின் கீழுள்ள பணிகளில் நியமனம்  செய்வதற்கான சட்டம்,  2010  (Tamil Nadu Appointment on preferential basis in the Services under the State of Persons Studied in Tamil Medium Act, 2010) ல் திருத்தம் மேற்கொள்வதற்கான சட்டம்.  

இந்திய குடியரசின் எழுபத்தொன்றாம் ஆண்டில் தமிழ்நாட்டின் சட்டமன்றத்தால் பின்வருமாறு இயற்றப்பட்டுள்ளது : -

1. (1) இந்தச் சட்டமானது, தமிழ் வழியில் படித்த நபர்களை  முன்னுரிமை அடிப்படையில் மாநிலத்தின் கீழுள்ள பணிகளில் நியமனம்   செய்வதற்கான (திருத்த) சட்டம்,  2020   (Tamil Nadu Appointment  on preferential basis in the Services under the State of Persons  Studied in Tamil Medium (Amendment) Act, 2020) என்று அழைக்கப்படலாம்.

(2) இது ஒரே நேரத்தில் நடைமுறைக்கு வரும்.

2. தமிழ் வழியில் படித்த நபர்களை  முன்னுரிமை அடிப்படையில் மாநிலத்தின் கீழுள்ள பணிகளில் நியமனம்   செய்வதற்கான சட்டம்,  2010 -ன்  2 வது பிரிவிலுள்ள உட்கூறு (d)  பின்வருமாறு மாற்றியமைக்கப்படுகிறது ;-  

”(d)" தமிழ் வழியில் படித்த நபர்(Persons Studied in Tamil Medium)  என்பவர்  மாநிலத்தின் கீழ் உள்ள சேவைகளில் எந்தவொரு நியமனத்திற்கும் பொருந்தக்கூடிய விதிகள் அல்லது ஒழுங்குமுறைகள் அல்லது உத்தரவுகளில்   பரிந்துரைக்கப்பட்ட   கல்வித் தகுதி வரையில் தமிழை பயிற்று மொழியாகக் கொண்டு படித்தவராவர்.  

விளக்கம்.  இந்த உட்பிரிவின் நோக்கத்திற்காக, -

(i)  எஸ்.எஸ்.எல்.சி   (SSLC) கல்வித் தகுதியாக பரிந்துரைக்கப்படும் சந்தர்ப்பங்களில், ஒருவர் தமிழை பயிற்று மொழியாகக் கொண்டு   எஸ்.எஸ்.எல்.சி வரை படித்திருக்க வேண்டும். 

(ii) மேல் நிலைக் கல்வி (Higher Secondary) கல்வித் தகுதியாகப் பரிந்துரைக்கப்படும் சந்தர்ப்பங்களில்,  ஒருவர், எஸ்.எஸ்.எல்.சி . மற்றும் மேல் நிலைக் கல்வியை தமிழை பயிற்று மொழியாகக் கொண்டு  படித்திருக்க வேண்டும்.

(iii) கல்வித் தகுதியாக டிப்ளோமா (Diploma)  பரிந்துரைக்கப்பட்ட சந்தர்ப்பங்களில், ஒருவர் எஸ்.எஸ்.எல்.சி மற்றும் டிப்ளோமாவை தமிழ் வழியில்  படித்திருக்க வேண்டும் அல்லது மேல்நிலைக் கல்வி  முடிந்ததும் டிப்ளோமா பெற்றிருந்தால்,  ஒருவர் எஸ்.எஸ்.எல்.சி, மேல்நிலைக் கல்வி மற்றும் டிப்ளமோ  ஆகியவற்றை  தமிழை பயிற்று மொழியாகக் கொண்டு படித்திருக்க வேண்டும். 

(iv) கல்வித் தகுதியாக ஒரு பட்ட படிப்பு (Degree) நிர்ணயிக்கப்பட்ட சந்தர்ப்பங்களில், ஒருவர் எஸ்.எஸ்.எல்.சி,  மேல்நிலைக் கல்வி மற்றும்  பட்டப் படிப்பை தமிழை பயிற்று மொழியாகக் கொண்டு படித்திருக்க வேண்டும். 

(v) கல்வித் தகுதியாக முதுகலை பட்டம் (Post Graduate Degree) பரிந்துரைக்கப்படும் சந்தர்ப்பங்களில், ஒருவர் எஸ்.எஸ்.எல்.சி, மேல்நிலைக் கல்வி, பட்டப் படிப்பு மற்றும்  முதுகலை பட்டப்படிப்பை தமிழை பயிற்று மொழியாகக் கொண்டு படித்திருக்க வேண்டும்.

Original English version of the Tamilnadu PSTM Amendment Act 2020  is given below

The following Act of the Tamil Nadu Legislative Assembly received the assent of the Governor on the 7th December 2020 and is hereby published for general information:

ACT No. 35 OF 2020.

 An Act to amend the Tamil Nadu Appointment on preferential basis in the Services under the State of Persons Studied in Tamil Medium Act, 2010. 

Be it enacted by the Legislative Assembly of the State of Tamil Nadu in the Seventy-First Year of the Republic of India as follows: 

1. (1) This Act may be called the Tamil Nadu Appointment  on preferential basis in the Services under the State of Persons  Studied in Tamil Medium (Amendment) Act, 2020. 

(2) It shall come into force at once. 

2. In section 2 of the Tamil Nadu Appointment on preferential Amendment of basis in the Services under the State of Persons Studied in Tamil  Medium Act, 2010, for clause (d), the following clause shall be substituted, namely: 

"(d) “person studied in Tamil medium” means a person who has studied through Tamil medium of instruction upto the educational qualification prescribed for direct recruitment in the rules or regulations or orders applicable to any appointment in the services under the State. 

Explanation.  For the purpose of this clause, - 

(i) in cases, where SSLC is prescribed as the educational qualification, one shall have studied upto SSLC through Tamil medium of instruction; 

 (ii) in cases, where a Higher Secondary Course is prescribed as the educational qualification, one shall have studied SSLC and the Higher Secondary Course through Tamil medium of instruction; 

(iii) in cases, where a diploma is prescribed as the educational qualification, one shall have studied SSLC and the diploma through Tamil medium of instruction or if the diploma is obtained after completion of Higher Secondary Course then one shall have studied SSLC, Higher Secondary Course and the diploma through Tamil medium of instruction; 

(iv) in cases, where a degree is prescribed as the educational qualification, one shall have studied SSLC, Higher Secondary Course and the degree through Tamil medium of instruction; 

(v) in cases, where a post-graduate degree is prescribed as the educational qualification, one shall have studied SSLC, Higher Secondary Course, degree and the post-graduate degree through Tamil medium of instruction.”
